Cancellation and Refund Policy β Training Products

Scope and Definitions
This Cancellation and Refund Policy (the "Policy") applies to all training products and services offered by Amalia Technologies GmbH ("Amalia", "we", "us") via our website or directly to customers ("Customer", "you"), including:
- Live Training β scheduled instructor-led courses delivered in person or via virtual classroom at specified dates and times;
- Self-Paced Training β pre-recorded on-demand digital training content, including video modules, downloadable materials, assessments, and related resources; and
- Custom or In-House Training β bespoke training programmes delivered at the Customer's premises or via a dedicated virtual session.
This Policy forms part of our General Terms and Conditions (AGB) and the applicable training service agreement. In case of conflict, the specific terms of the training service agreement prevail.
References to "business days" mean Monday to Friday, excluding public holidays observed in the State of Hesse, Germany.
Statutory Right of Withdrawal for Consumers
1.1 If you are a consumer within the meaning of Β§ 13 of the German Civil Code (BGB), you have a statutory right to withdraw from a contract concluded at a distance (e.g., via our website) within fourteen (14) days from the date of conclusion of the contract, without giving reasons.

1.2 To exercise your right of withdrawal, you must inform us of your decision by an unambiguous written statement (e.g., a letter sent by post or an email) at the address set out in Section 10. You may use the model withdrawal form available on our website but are not required to do so.

1.3 Self-Paced Training (digital content): If you have expressly consented to the commencement of performance before the expiry of the 14-day withdrawal period and have acknowledged that you lose your right of withdrawal upon such commencement, the right of withdrawal expires once access to the digital content has been provided (Β§ 356(5) BGB).

1.4 Live Training: Where a Live Training is scheduled to take place within the 14-day withdrawal period and you have requested us to begin performance during this period, a pro-rata charge for services already rendered may apply if you subsequently exercise your right of withdrawal.

1.5 This Section 2 does not apply to Customers that are not consumers (i.e., businesses, freelancers, and public-sector bodies acting within their trade, business, or profession).
Cancellation of Live Training by the Customer
2.1 Cancellation requests must be submitted in writing (email is sufficient) to the address set out in Section 10 and are effective only upon our written acknowledgement.

2.2 The following refund schedule applies, based on the notice period before the scheduled start date of the training:

2.3 In place of a refund, you may request a credit voucher valid for twelve (12) months from the date of cancellation, applicable to any of our training products of equivalent value. Credit vouchers are non-refundable and non-transferable without our prior written consent.

Rescheduling and Substitute Participants
Rescheduling
You may reschedule your participation to a later session of the same or an equivalent training, subject to availability, provided the request is made in writing at least seven (7) calendar days before the scheduled start date. One reschedule per booking is permitted free of charge; subsequent reschedules may incur an administrative fee of β¬50 per participant.
Substitute participants
You may nominate a substitute participant at no additional cost up to twenty-four (24) hours before the scheduled start date, provided the substitute meets any stated prerequisites for the course. The substitute must be notified in writing to the address in Section 10 with their full name, email address, and, where relevant, job title or qualifications.
Self-Paced Training
4.1 Except where the statutory consumer right of withdrawal under Section 2 applies, purchases of Self-Paced Training are final and non-refundable once access has been granted.

4.2 Access to Self-Paced Training is personal to the named participant and may not be shared, resold, or transferred without our prior written consent.

4.3 Where access has not yet been granted, you may cancel and receive a full refund within thirty (30) calendar days of purchase by writing to the address set out in Section 10.
Custom or In-House Training
5.1 Cancellation terms for Custom or In-House Training are set out in the applicable statement of work or training service agreement. In the absence of specific contractual terms, the following schedule applies, based on the notice period before the agreed training date:

5.2 Any travel, accommodation, venue-hire, licensing, or other out-of-pocket expenses incurred by us up to the date of cancellation remain payable in full in addition to the cancellation fee.
Cancellation or Postponement by Amalia Technologies
6.1 We reserve the right to cancel or postpone any Live Training if the minimum number of participants is not reached, or due to circumstances beyond our reasonable control (including force majeure events, trainer illness, or significant technical failures).

6.2 In such cases, you will be offered, at your choice:
- enrolment in the next available session of the same training at no additional cost; or
- a full refund of the fees paid for the affected training.

6.3 Beyond the remedies in Section 7.2, our liability in connection with a cancellation or postponement is limited to the fees paid for the affected training. We are not liable for incidental costs such as travel, accommodation, or loss of working time, except in cases of intent or gross negligence, or where mandatory statutory liability applies.
No-Show
7.1 If the registered participant fails to attend the training without prior written cancellation, no refund or credit will be issued and the full training fee remains payable.

7.2 For virtual Live Training, a no-show is recorded where the participant does not join the session within thirty (30) minutes of the scheduled start time.
Refund Processing
8.1 Approved refunds are processed within fourteen (14) business days of our written acknowledgement of the cancellation.

8.3 Bank fees, currency conversion losses, and payment processor charges associated with the refund are borne by the Customer, unless otherwise required by mandatory law.

8.2 Refunds are made to the original method of payment unless otherwise agreed in writing.

- Full name and, where applicable, company name
- Order or invoice number
- Preferred resolution (refund, credit voucher, or reschedule)
- Name of the training product
- Reason for cancellation (optional)
- Scheduled date (for Live or Custom Training)
Governing Law and Jurisdiction
10.1 This Policy is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

10.2 For Customers that are merchants (Kaufleute) within the meaning of the German Commercial Code (HGB), legal persons under public law, or special funds under public law, the exclusive place of jurisdiction is Frankfurt am Main, Germany. Mandatory statutory consumer protection rights remain unaffected.

10.3 Online dispute resolution. The European Commission provides a platform for online dispute resolution (ODR) at https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Changes to This Policy
We reserve the right to amend this Policy from time to time. The version of the Policy published on our website at the time of your purchase applies to your booking.
